I have more to the story. As I said earlier I somehow got past the black screen problem and had all the latest updates. Somewhere along the line I had changed some settings in my bios to be able to boot to a usb stick, and even though everything was working fine I decided to reset the bios settings and load the defaults, which after somehow was giving me the black screen again. I tried what I posted earlier but I couln't get the windows update to download and install before windows automatically updated the driver and it went blank. So I tried the intel driver from hp support from 8/19 and it works fine even with update 3939 installed, and now when I check for windows updates that slightly newer intel driver is no longer coming up. So it's a weird glitch or something but I'm no expert on this stuff.
One other piece of information to throw out there is that I tried a fresh install with an 8.1 iso I downloaded with a different retail key I had. Their was no blank black screen error from fresh install with the latest intel driver and all windows updates but unfortunately it would not let me change the key to the windows 8 key that came with the laptop.
